Specialist
Areas
Private
client
This heading includes those services that will meet all the
needs of private clients and trustees in order to protect
and advance their interests in the many circumstances when
legal issues are involved
Examples of the type of matters in which this
practice can assist include:
• Tax planning, including the preservation of the Estate,
the family farm and the family business
• The creation and administration of Trusts in England
and Wales and overseas
• Wills and Codicils, and the Administration of Estates
• Advising on and assisting in the problems of the elderly,
including preparation of Powers of Attorney; Court of Protection
applications, and acting on behalf of the elderly
• Residential and commercial conveyancing
“Where we believe it is in the client’s
interest, whether because of the urgency attaching to a particular
matter or its complexity (or elements of it), we may advise
that UK-based assistance or expertise is sought – for
example from a Solicitor, a barrister or an accountant.”
Contested Probate
A Will can be challenged in certain circumstances: we have
experience of both contesting and opposing a challenge to
a will and can advise and act in such matters.
Disputes
& Litigation
Litigation arises out of a wide range of situations and involves
many specialist areas of law. We have considerable experience
of the legal problems clients are likely to encounter and
of remedies available through the Courts and Tribunals to
deal with them. In advising clients, the financial and other
implications of a decision to litigate are always carefully
considered, and presented for discussion with the client.
Particular urgency is attached to some litigation and we are
accustomed to the demands of such matters. Where appropriate,
Counsel is instructed on behalf of the client: we are conscious
of the importance of skilled advocacy.
In some cases we will recommend Mediation.

Amongst
the areas of litigation that we have experience of are:-
•
Landlord and Tenant, as to commercial, agricultural and residential
properties
• Breach of contract, including building disputes, claims
arising out of the supply of goods and services and the collection
of debt
•Property disputes, including boundary disputes and
actions for nuisance and breach of covenant
• Personal injury and medical negligence claims
• Unfair and wrongful dismissal claims
• Breach of copyright, passing-off and other related
matters
• Defamation
• Banking and consumer credit
• Professional negligence
• International carriage of goods (CMR) claims
Traffic
Offences
We have acquired considerable experience over the years in
acting for individuals and companies in connection with road
traffic and road transport matters. These include inter alia
prosecutions for speeding, use of unsafe or overloaded vehicles,
drink-driving and tachograph offences, involving cars, horse-boxes,
trailers, articulated lorries and most types of goods vehicle.
We will advise when expert evidence may assist the client
in presenting his or her case and we have access to a substantial
panel of expert witnesses.
Not all prosecutions can be successfully defended, and we
will advise when this seems the case; we frequently appear
in mitigation for clients who have pleaded guilty to an offence.
AND WHAT WE DON’T DO
There are areas that we do not deal in, which include divorce
and family law and shipping law, nor do we undertake Publicly
Funded work, or work on a contingency fee basis or under A.T.E.
insurance.
